NORTH GOA SP TO DECIDE ON CHEATING CASE AGAINST ADVOCATE AMIT DESAI & ADVOCATE ASHWIN BHOBE.

With the Panaji Police refusing to register a cheating case against Adv. Amit Desai and Adv. Ashwin Bhobe, a petition under Section 154(3)of the Criminal Procedure Code has been filed by Adv. Aires Rodrigues before the Superintendent of Police North Goa Mr. Arvind Gawas.

Adv. Aires Rodrigues has in his petition stated that Mumbai Advocate Amit Desai had fraudulently raised bills and had claimed Rs five lakhsfor four hearings he never appeared for before the Bombay High Courtat Goa in the Ryan Fernandes death sentence confirmation case.

Adv. Rodrigues has further stated that Adv. Amit Desai’s raising false bills was a clear act of cheating, while Adv. Ashwin Bhobe criminally conspired and corroborated in the act by submitting those bills to the government knowing that the bills were falsely raised when there was factually no such appearances.

Adv. Rodrigues has also stated that Adv. Amit Desai and Adv. Ashwin Bhobe with common intention conspired and dishonestly induced theState Government into paying the bills for appearances not made and falsely represented before the Government that the four appearances in Court were truly made.

Adv. Rodrigues has drawn SP Arvind Gawas’s attention that as per the terms of his appointment, Adv. Amit Desai was only entitled to claim Court appearance fees and not any conference or other fees.

Adv. Rodrigues has stated that Adv. Amit Desai and Adv. Ashwin Bhobe had committed offences of cheating, misappropriation of property, andbreach of trust under Section 420, r/w Sec 34 & section 120-B of theIndian Penal Code.

Stating that Adv. Amit Desai and Adv. Ashwin Bhobe used the false bills to cheat the Goa Government, Adv. Rodrigues has urged the SPNorth to direct the case to be registered and be speedily investigated as the offences relate to cheating the State exchequer.

It may be recalled that on the advice of Advocate General Mr. SubodhKantak the Goa Government by an order dated 30th October 2008 had appointed Adv. Amit Desai to appear in the death sentence confirmation case before the Bombay High Court at Goa at a fee of Rs 1, 25, 000 per hearing. By the same order Adv. Ashwin Bhobe was also appointed as Advocate on record to assist Adv. Amit Desai at a fee of Rs 5000/- per hearing.
