DEMOLITION ORDER IN
CANDOLIM.
In Candolim the village
Panchayat acts sometimes like a Hamlet – to be or not to be – for some
important decisions when demolitions of structures of big non-goan people are concerned. Inspite of
the High Court Directive in Writ petition No. 90/2000 and Circular No
15/77/DP/CIRC/2000/1649 dated 10.07.2000 issued by the Director of Panchayats
to all the Panchayats in Goa to strictly follow the instructions of the said Circular according to which
unauthorized construction on the Roof-Top of Block Q by the Non-Goan Builder
M/s R. & H.Spaces Pvt. Ltd., at Anna Vaddo Candolim, becomes illegal and for
which the demolition order was issued to the Builder by the Candolim Village
Panchayat to demolish the said structure within 30 days from the receipt of the
order. This is in reference to the
complaint filed by one local Mr.Anthny J. D’Souza who is fighting this battle against the above mentioned Non-Goan Builder.
However, the Candolim
Panchayat has failed to carry out the demolition at the cost of the builder and
also failed to disconnect the Electricity connection and also Water connection
as per the directive of the Honourable High Court of Panaji Goa vide its order
in Writ Petition No. 90/2000 till date and thereby proving beyond doubts that
there is no authority in the State of Goa to take legal action against the
illegal construction carried out by the non-Goan big hotelier M/s R. & H.
Spaces Pvt. Ltd., at Anna Vaddo, Candolim, for the unauthorized construction
they constructed inconveniencing one local Mr. Anthony J. D’Souza who
has been fighting this battle against the above mentioned non-Goan big hotelier.
As per the Goa Panchayat
Raj Act, 1994 if within the stipulated period, after passing the Resolution No.
10(35) in the monthly meeting on 06.09.2017 to demolish the illegal structure,
is not carried out then the local Panchayat has to carry out the demolition
work. But surprisingly, Candolim
Panchayat under the Hamletic influence
is still silent whereas in the same locality for such structures
demolition decisions are carried out with sprinting speed against the small and
poor Goans.
According to many
locals the Candolim Panchayat is playing
the game of delay because they must have been bribed with lakhs or crores. And
is it difficult to admit this statement?
Are our Panchayats not bribe prone IN GOA? Are our Sarpanches and Ward
members not purchasable commodities? And especially the Catholics, mainly the
naturalized Goans? Or else how they built their business empires such as
Hotels, Restaurants and Bungalows? In my
locality some of the elected members who were earlier totally bankrupt after
getting elected they are become “lakhpotis”.
How and from where they amassed such a hefty wealth without doing any
productive job? Is it not thru the bribe
money they have extorted from the locals in exchange of the Panchayat services
they rendered?
In conclusion, this
incident will set a bad example to defy the Panchayat to demolish the illegal construction on the
Roof-Top of Block Q as mentioned above. As per the Goa Panchayat Raj Act 1994
and also as per Honourable High Court Order, this will amount to remiss of duty by the village Sarpanch for which he could
be disqualified from the post.
Also Block “Q” which
constructed by M/s R. & H. Spaces Pvt. Ltd., is close to the residential
house of Mr. Anthony J. D’souza obstructing air, light etc. and thereby
violating the provision of Indian “Easements” Act 1882.
